Court of Appeal Dismisses B.N. Kotecha & Sons' Case Against Amalo Company Limited

In a recent ruling, the Court of Appeal in Kisumu dismissed an appeal filed by B.N. Kotecha & Sons Limited and Hemal Kotecha against Amalo Company Limited, ordering the appellants to bear the costs of the appeal. The case, identified as Civil Application No. 81 of 2019, was adjudicated by Justices Hannah Magondi Okwengu, Fatuma Sichale, and Patrick Omwenga Kiage, who upheld the previous decision in favor of Amalo Company Limited. 

The dispute originated from a contractual disagreement between the parties, leading to legal proceedings initiated by Amalo Company Limited against B.N. Kotecha & Sons Limited and Hemal Kotecha. The High Court at Kisumu had previously ruled in favor of Amalo Company Limited, prompting the appellants to seek recourse at the Court of Appeal. 

This ruling underscores the judiciary's role in resolving commercial disputes and emphasizes the importance of adhering to contractual obligations within Kenya's legal framework.
